In today’s episode Craig interviews Tom Shay from Profits Plus Solutions. We like to run a positive show around here at Corporate Real Estate Podcast. Craig has great working relationships with all parties involved in making great deals: attorneys, landlords, landlord agents, etc. Craig likes landlords! He likes to say they’re good people, and most of the time they are. Tom Shay would say the same thing, but he’s here today to give everyone a little heads up so they can learn from someone else’s pain. He shares a few of his experiences dealing with inexperienced landlords.

Sometimes the landlord just doesn’t have a good working knowledge of how deals, leases and business relationships should go. Tom recounts an incident where a landlord failed to notify tenants that their signage was going to be discarded and changed and that the entire facility was going to be remodeled. This is just an example of poor communication and these types of encounters can easily be avoided.

Whether you’re a landlord or a renter, you want the lease agreement to protect your rights and be mutually beneficial. A landlord should want the businesses that rent from them to thrive and vice versa.

51 – Spouse Won’t Sign on Your Personal Guarantee? Here’s How to Compromise With the Landlord and Keep the Deal Alive

You’re in luck because in this episode Craig shares an ingenious solution to a pretty common problem. Here’s the situation: You are ready to start a new business; it’s time to open up shop. What are you going to need? Well, when you sit down with a landlord to sign a lease on this new shop of yours, he or she is going to want you to personally guarantee the lease.

If your spouse doesn’t want to sign the personal guarantee, and they’re right, by the way, (you shouldn’t want to sign it either) then you’re going to be in a pickle! The landlord will probably insist. So, what can you do? Craig has had Herculean success negotiating in these types of situations, this is, he’s avoided personal guarantees by having his clients show the landlord that they can pay more rent up front. Then, the landlord, in essence, gets the security they’re after and the client doesn’t risk their personal assets.

The typical client is referred to him by their attorney or banker and it’s often due to some sort of strategic problem with their lease because. Perhaps they didn’t have a plan from the beginning and now they need help. 80% of people that he works with renew their existing lease; so, it’s not usually about relocation. What it is about is getting help to reduce their lease cost. He offers a ‘no cost’ service to assess their renewal needs, operating expenses or CAM fees.
